MOOMIA.COM DOES NOT TOLERATE SPAM. ANY ACCOUNT SUSPECTED OF SPAMMING WILL BE INVESTIGATED AND IF FOUND GUILTY OF SPAMMING WILL BE AUTOMATICALLY CLOSED, NO REFUND WILL BE ISSUED. IF YOU ARE A VICTIM OF SPAM ABUSE, READ THE DETAILED MESSAGE HEADER, LOCATE THE DOMAIN FROM WHERE THE MESSAGE ORIGINATED AND CONTACT THE ADMINISTRATOR OF THAT DOMAIN AND COPY US AT abuse@moomia.com. IF THE ORIGINATING DOMAIN IS moomia.com, WE WILL INVESTIGATE THE ISSUE AND TAKE THE PROPER ACTION, WHICH WILL USUALLY RESULT IN CLOSING THE SPAMMER'S ACCOUNT AND BLOCK THEIR IP ADDRESS IF IT IS STATIC.

Moomia.com uses Spamcop, Spamhaus, DSBL and ORDB to filter out spam.

YOU AGREE NOT TO USE YOUR MOOMIA.COM ACCOUNT AS DROP BOX TO RECEIVE REPLIES TO YOUR SPAMS, EVEN IF THE SPAM DID NOT ORIGINATE FROM MOOMIA.COM.

MOOMIA.COM RESERVES THE RIGHT TO SUSPEND AN ACCOUNT IN THE EVENT THAT A SPAM COMPLAINT WAS FILED AGAINST THIS ACCOUNT. MOOMIA.COM WILL THEN CONDUCT AN INVESTIGATION. IF EVIDENCE SHOWS THAT THIS ACCOUNT WAS USED AS A DROP BOX OR TO COLLECT REPLIES FROM SPAM, REGARDLESS FROM WHERE THE SPAM ORIGINATED, MOOMIA.COM RESERVES THE RIGHT TO PERMANENTLY CLOSE THE ACCOUNT IN QUESTION WITHOUT PRIOR NOTIFICATION AND MOOMIA RESERVES THE RIGHT TO KEEP ANY SUBSCRIPTION MONIES, YOU WILL NOT BE REFUNDED. YOUR IP ADDRESS WILL BE BLOCKED AND YOU WILL NOT BE REFUNDED ANY OF YOUR SUBSCRIPTION MONIES.

 
MOOMIA AGREES TO PROVIDE YOU WITH A WEB-BASED EMAIL SERVICE FROM HEREON CALLED THE SERVICE. THIS SERVICE WILL ALLOW YOU TO STORE UP TO 200 MEGABYTES OF EMAILS. MOOMIA RESERVES THE RIGHT TO CANCEL YOUR SUBSCRIPTION AT ANY TIME WITHOUT ANY NOTICE WITHOUT OBLIGATION ON MOOMIA.COM's PART.

MOOMIA.COM DOES NOT ISSUE ANY REFUNDS UNLESS MOOMIA.COM FAILS TO PROVIDE SERVICE AS DESCRIBED.

ALTHOUGH MOOMIA.COM TRIES TO DELIVER GOOD PERFORMANCE, MOOMIA.COM DOES NOT GUARANTEE PERMANENT CONNECTION, LINK, SOFTWARE OR ACCESS PERFORMANCE. MOOMIA.COM DOES NOT GUARANTEE DATA INTEGRITY, INFORMATION THAT IS STORED ON ANY MOOMIA.COM SERVERS AND/OR EQUIPMENT CAN BE DELETED DUE TO EXTERNAL INTERFERENCE OR ACCIDENTS.
if your account remains inactive (i.e. you do not login) for a period of 90 days, moomia.com can and will close your account and delete your folders and messages without authorization.

YOU MAY USE THE SERVICE BASED ON ONE THE FOLLOWING CONDITIONS:

  • YOU AGREE TO SIGNUP TO MOOMIA.COM USING THE http://www.moomia.com/signup.htm PAGE ONLY IN AN INTERACTIVE MANNER.

  • THE MOOMIA.COM MEMBER IS SOLELY responsible for any content that you post or transmit OR STORE on or through this Service.

  • at any time, Moomia CAN and will run scheduled and un-scheduled system maintenance to keep its system in top performance, secure and up to date with latest system and application  software

You will not use the Service to distribute, link to, or solicit content that:

  • is unlawful, harmful to minors, threatening, harassing, abusive, defamatory, vulgar, gratuitously violent, obscene, pornographic, libelous, invasive of another's privacy, or racially, ethnically or otherwise offensive; 

  • includes personally identifiable information about children; 

  • infringes someone else's intellectual property or other rights; 

  • advocates or solicits violence or other criminal conduct;

  • violates any law, regulation, or contract; 

  • promotes participation in multi-level or pyramid marketing initiatives; 

  • constitutes a raffle, sweepstakes, lottery, or any other form of gambling; 

  • specifically advertises firearms or ammunition, tobacco, alcohol, pornography, or any other product or service that is illegal in Virginia, California, or the domicile of either the distributor or recipient;

  • constitutes unsolicited or unauthorized advertising, junk or bulk e-mail, spam, chain letters, or any other unsolicited commercial OR PERSONAL communication.

  • contains software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment. 

  • YOU AGREE TO THE ABOVE LISTED TERMS OF USE AND PRIVACY STATEMENTS, IF YOU VIOLATE ANY OF THESE TERMS OF USE, YOUR ACCOUNT WILL CLOSED, YOUR INFORMATION WILL BE SENT TO LEGAL AUTHORITIES FOR FURTHER INVESTIGATION. YOU WILL POSSIBLY BE SUBJECTED TO FINE(S) AND/OR IMPRISONMENT ACCORDING TO THE LAWS OF THE U.S.
moomia.com adds a footer to each outgoing message that contains an anti-spam key. this key would be used in case a message is suspected to be spammed.

you agree to allow moomia.com to add this footer to every message that you send through the moomia.com network.

using the anti-spam key users on public networks such as the web can go to a page on the moomia.com website and check whether the message they received in authentic. they can also use this page to file a spam complaint.
moomia.com also adds a footer to each outgoing message that could contain advertising text and/or URL. You agree to allow moomia.com to add this footer to every message that you send through the moomia.com network.

MOOMIA.COM PROVIDES A SAFELIST FOR ITS MEMBERS TO ALLOW THEM TO EXCHANGE ADVERTISING MESSAGES. MOOMIA.COM'S SAFELIST IS STRICTLY INTERNAL AND ALL MEMBERS ON THAT SAFELIST ARE MOOMIA.COM OPT-IN MEMBERS. MOOMIA.COM'S SAFELIST DOES NOT USE THE CONVENTIONAL E-MAIL MESSAGING SYSTEM (SUCH AS SMTP/POP3) AND THEREFORE SAFELIST MESSAGES DO NOT LEAVE THE MOOMIA.COM NETWORK. IF YOU ARE A VICTIM OF SPAM, REST ASSURED THAT OUR SAFELIST MEMBERS ARE NOT RESPONSIBLE. any part of the Service.

EACH SAFELIST SERVER CAN CONNECT TO MOOMIA USING A MAXIMUM OF 20 SIMULTANEOUS CONNECTIONS. THIS TO MINIMIZE THE CHANCE OF INTENDED SPAM. if the number of connection exceeds 20, the moomia.com server will send a 450 status code which could be interpreted as a bounce by the safelist.

THIS NUMBER (20) MAY VARY DEPENDING ON THE AMOUNT OF TRAFFIC BEING GENERATED on THE MOOMIA.COM NETWORK.

Moomia.com and moomia llc. are not responsible for any damaged and/or losses incurred because of the bounce being sent to the safelist.
You will comply with all applicable laws and regulations regarding online conduct and content. You will not use the Service to collect, store, or use information about others for the purpose of sending unsolicited or unauthorized communications. Except as we specifically authorize (via license or otherwise), you will not reproduce, distribute, or commercially exploit any part of the Service.
MOOMIA.COM SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE OR FOR COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE SERVICE OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF MEMBER'S TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLES, EVEN IF MOOMIA.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
